Terms and Conditions

This translation of the old version (04 July 2018) has been made for the convenience of our English speaking costumers. However, only the Dutch version is legally binding.


Parties

These general terms and conditions apply to all contracts and relationships between you and the IAPC foundation.

Offers to purchase

Any offer, in whatever way publicised, is without liability. Offers are made subject to availability of the goods ordered.

Images and descriptions

All images and descriptions are for indication purposes only. Furthermore, misprints in item specifications published by the IAPC foundation are not binding. The IAPC foundation cannot be held responsible for product specifications published by manufacturers, including where the IAPC foundation has made reference to those specifications.

Payment methods

The IAPC foundation accepts the following payment methods:

  • Maestro
  • V-Pay
  • Cash in euros (except for €500 and €200 notes)
  • Bank transfer

Goods and Pricing

All prices are shown in euros and include VAT. Misprints are not binding. All prices are recommended prices. Placing an order commits you to purchase. We will notify you if the price increases by more than 5%, and you will have the option to cancel. You are likewise committed to purchase if you choose a replacement item or do not wish to cancel. If you choose to cancel an order following notification of a price increase, then the order lapses entirely, along with the commitment to purchase those goods.

Delivery

As supplier, it is our responsibility to deliver goods you order from the IAPC foundation. Where stated, the IAPC will add delivery costs to the list price. The IAPC foundation strives for a typical delivery time of one and a half weeks for an order. This timescale is indicative only. All orders need to be collected from our premises. Where goods prove difficult to obtain, the IAPC foundation will get in touch with you regarding this. Where a purchase is not completed for reasons other than arising from a price increase as mentioned, then the IAPC foundation has the right to hold you liable for any costs incurred.

Cooling-off period

The IAPC foundation does not offer a cooling-off period once goods are ordered. Goods supplied from stock can be returned within 14 days providing the original packaging is intact and on production of the original sales receipt. Customers should satisfy themselves before leaving the shop that the goods purchased are in good condition. Warranty claims submitted afterwards will be considered by the IAPC foundation only at their entire discretion.

Defects

The IAPC foundation is responsible for the goods it supplies and for their delivery. Should the goods supplied not fully comply with the contract, the IAPC foundation will, at their discretion, either supply the missing item or repair or replace the goods supplied.

Liability

The IAPC foundation accepts no liability for incidental damage, including consequential damage, loss of profit, missed savings and damages from business interruption. The IAPC foundation’s maximum liability for compensation for damage arising directly from defects attributable to fulfilling the contract is limited to the amount paid for those goods which directly or indirectly caused the damage. The IAPC foundation can in no way be held liable for compensation for any other damage, regardless of the grounds on which a claim for compensation might be based. This limit of liability will not apply if the damage is caused intentionally or through deliberate recklessness by the IAPC foundation or where this would affect your statutory rights.

Applicable law and dispute resolution

Dutch law applies to all legal relations between you and the IAPC foundation. The UN Convention on the International Sale of Goods does not apply.
